Terms and Conditions of Use

1. Publisher

2. Purpose

Climaxoid is an entertainment app: an immersive experience with fictional companions created or assisted by artificial intelligence. It includes chat, voice and live calls, Sensation mode, catalogue creations and related features. The companions are not real people. The app is distributed on Google Play. These terms govern your use of the app. Download and payments also follow Google Play's terms. Google is the store and the payment processor. Google is not the publisher of the app and is not responsible for the conversations, the images or the companions.

3. Acceptance

Before you use the app, on the age-verification screen, you must confirm that you are at least 18 and accept these terms and the Privacy Policy. If you do not accept them, do not use the app. Using the app means you accept the version then in force.

4. Access, 18 and over only

The app is strictly for people aged 18 or over. It is not directed at children. It is not part of Google Play's Designed for Families program and must not be installed for a child. You enter your date of birth. We store it to verify your age. Anyone under 18 is blocked, even with a parent's permission or on someone else's device. A false date of birth is a breach of these terms. We may then close the account and delete the data. You confirm that you have the legal capacity to enter into a contract.

5. Account

You can create an account with an email address and a password, or with Google Sign-In. You can request a password-reset link from the sign-in screen. Your login details are personal. You are responsible for keeping them confidential and for any use of your account. Write to apps@climaxoid.com promptly if you believe someone else is using your account. One person, one account. You must not share, sell or lend your account, and you must not open several accounts to obtain extra rewards or to bypass a limit.

6. Tokens and in-app purchases

Some features consume tokens. The cost is shown in the app before the action. For example, a chat message or a Sensation interaction consumes tokens, and a live voice call consumes tokens over time at the rate shown on the call screen. We may change these costs to reflect our AI and infrastructure costs. The cost shown when you confirm the action is the cost that applies.

  • You can buy token packs in the shop. Payment is made only through Google Play Billing. No other payment method is offered.
  • The price is the price displayed by Google Play in your currency, including taxes when Google presents them that way.
  • Tokens are a virtual item. They have no cash value. They cannot be resold, transferred, exchanged or redeemed for money.
  • If the shop offers a subscription, it is billed and renewed by Google Play. You can cancel it in your Google Play subscriptions. Cancellation stops the next renewals. The period already paid may continue until it ends, as shown by Google Play.
  • An optional non-consumable purchase can permanently increase the daily reward. It stays linked to the Google account used for the purchase and can be restored through Google Play.
  • Unused tokens remain on the account until it is deleted or closed for a breach. They are then lost, with no cash refund, except where Google Play or the law requires a refund.
  • A purchase is completed when Google Play confirms the payment. A pending payment is credited only after that confirmation.
  • Refunds are handled by Google Play under Google Play's refund rules. If a purchase is refunded or charged back after the tokens were credited, we may remove those tokens, or close the account in case of abuse. If purchased tokens are not delivered, write to apps@climaxoid.com.

7. Rewarded video ads

When the feature is available, you may watch a rewarded video to earn tokens, from chat or from Sensation mode. A daily limit may apply and is shown in the app. Before the ad, we may ask for your consent to advertising data, in the app and, where required, on Google's consent screens. You can accept or refuse, and you can change this later in My account. The reward is credited only after a complete view confirmed by the ad provider (Google AdMob and, where applicable, its advertising partners). We do not guarantee that an ad will be available. If you close the ad early, the reward is not granted. Refusing consent may make rewarded ads unavailable. You can still use the app with tokens you buy. We may refuse a reward in case of fraud, use of a modified app, or repeated viewing meant to abuse the limit.

8. Daily reward

The app may offer a daily reward in tokens, under the rules shown in the app. Amounts may change. We may change or stop that reward. An optional purchase can increase it, as described in section 6.

9. AI-generated content

Characters, messages, voice, calls, Sensation interactions and images are produced for entertainment.

  • They are fictional, or assisted by artificial intelligence. You are talking to an AI, not to a real person.
  • Content may be false, incomplete, inconsistent or unexpected. It is not medical, psychological, legal, therapeutic, relationship or other professional advice. Do not rely on it for a decision about your health, your safety or your rights. If you are in danger or in distress, contact local emergency services.
  • Companions and role-play are between fictional adults. Safety filters may refuse, stop or rewrite a request that is illegal or that breaches these terms, in particular any content involving a minor. Filters are not perfect.
  • If a reply seems inappropriate, report it in the conversation. You can also report a generated image.
  • You must not try to bypass the filters (jailbreak, hidden instructions, or role-play used to obtain prohibited content).

10. Your creations

You can create a companion with the catalogue tools. That companion must be an adult. The age choices in the app start at 18. You must not create a companion that depicts a real minor, and you must not use a real person's identity to harass, defame or deceive that person, or to generate sexual content about that real person. You remain responsible for the text and the choices you submit. You grant us a license, limited to operating the service, to host that content, send it to our technical and AI providers, moderate it and show it back to you. This license ends when the content or the account is deleted, except for copies we must keep to comply with a legal duty or to handle a report, a dispute or fraud.

11. Prohibited content

You must not request, create or try to obtain:

  • any sexual, romantic or exploitative content involving a person under 18, real or fictional, including any attempt to present an adult companion as a minor;
  • child sexual abuse material, grooming, or any content that sexualizes a minor;
  • content that facilitates a real-world crime (violence, terrorism, scams, sexual exploitation);
  • non-consensual intimate content of a real person, or harmful impersonation of a real person;
  • harassment, threats or hateful content aimed at a real person;
  • content that encourages suicide or self-harm;
  • any other content prohibited by French law or by Google Play policies.

A breach may lead to an immediate block of the reply, removal of the content, suspension or deletion of the account and, where the law requires it, a report to the authorities. We apply zero tolerance to any content involving a minor.

12. Reports and moderation

In a conversation you can report a reply. You can also report a generated image. We review reports and we may remove content, limit a feature or close an account. We do not promise to review every conversation in advance. You can also write to apps@climaxoid.com.

13. Intellectual property

The app, its name, the companions we provide, the scenarios, images, voices, texts and software are protected and belong to SAS LeadForge or its partners. We grant you a personal, non-exclusive, non-transferable license to use the app for private entertainment, for as long as your account is open and these terms are respected. You must not copy, extract, resell, publicly share or reuse our content to train another model, and you must not reverse engineer the app in order to bypass security, payments or the filters. Exceptions provided by law, including for interoperability, still apply.

14. Prohibited behavior

You must not:

  • use the app if you are under 18;
  • use a bot, a script, or a modified or unofficial client;
  • bypass Play Integrity, App Check or another security check;
  • cheat rewarded ads or purchases;
  • resell tokens or an account;
  • overload the service;
  • collect other users' data;
  • use the app in a way that breaches the law or Google Play policies.

If a security check fails, access may be refused.

15. Availability and changes to the service

We work to keep the app available. We do not guarantee continuous or error-free operation. We may add, change or remove features, companions, prices, subscriptions and token costs. AI models may change, and so may the replies. Maintenance, a provider outage or a legal duty may interrupt the service.

16. Liability

The app is provided for entertainment. To the extent permitted by law, we are not liable for indirect damage, for the loss of tokens if the account is closed for a breach or deleted, or for a decision you make based on an AI reply. Nothing in these terms excludes a liability that the law does not allow us to exclude, in particular in case of bodily injury, fraud or gross negligence, or the mandatory rights of consumers.

17. Account deletion and termination

You can delete your account at any time in the app, from the account area. Deletion is permanent. You can also request it at:

Deletion removes the account and the associated data, as described in the Privacy Policy. Unused tokens are lost and are not converted into money. A subscription, if you have one, must also be cancelled in Google Play, otherwise Google may continue to bill it. We may suspend or delete an account in case of a breach of these terms, of the law or of Google Play policies, in case of fraud or refund abuse, or if we learn that the user is under 18. Unused tokens may then be cancelled.

You accept it together with these terms. In short, we process your account, your date of birth, your conversations, your creations and, if you use a call, your voice, in order to provide the service, verify your age and prevent fraud. Messages, images and voice are processed by our AI providers (for example Google Cloud / Vertex AI, OpenAI, or others we integrate) only to generate the reply, as described in the Privacy Policy.

19. Changes to these terms

We may update these terms, for example to reflect a new feature or a legal requirement. The date at the top will change. If you keep using the app after the update, you accept the new terms. If you refuse them, stop using the app and delete your account. For an important change, we will inform you in the app or by email when we can.

20. Applicable law

These terms are governed by French law. If you are a consumer in the European Union, the United Kingdom or another country, you keep the mandatory protections of the country where you live. A consumer may bring a dispute before the courts of their place of residence. Otherwise, the courts of Rennes (France) have jurisdiction. These terms exist in several languages. If the wording differs, the French version prevails.
